Abstract (EN)

With the progress of technology and especially proliferation of social media, offense of breach of private life's privacy that nowadays has started to be a frequent crime has been made an enquiry subject. To be implemented this offense correctly, definitions of private life's notion and private life's scope are needed to be clarified. People's life occur from the three different life areas, public area, private area within the meaning of narrow, secret area. Secret area is the area which is not interfered in anyway. Private area, in a narrow meaning, can only be interfered for a higher cause like providing security of the country. Yet the public area is the area that private life of people is least protected. With the most general expression, scope of private life includes secret of people, personal data, family life, person's contacts and home. The offenses that protect the privacy of private life especially have been regulated on the ninth section of the TCK. Besides some special provisions that protect special subjects such as communication, on the TCK matter 134, the offense matter that is not found on the other matters as a general qualification but is going to be implemented on the actions that breach the privacy of the private life has been regulated. The Perpetrators of this crime need to make an effort to make this offense occurred. Otherwise, everybody learns something about someone's private life every day. Realization of breach by recording images and voices has been regulated as aggravating qualification case. Similarly on the second subsection of the matter, that realization of the breach of privacy of private life by revealment has been regulated. While realization of the breach action by way of media organs has been regulated as aggravating qualification case on the first section of the matter, with the date 02.07.2012 the law no.6352, this qualification case has been cancelled.
