The law on crime of bribery, whic is regulated in the "Crimes Aganist the Reliability and Functioning of th Public Administration" section of the Turkish Penal Code, is included in the articles 252 and 254. In general, the publica servant demands an unfair advantege in order to fulfill or not to fulfill a duty included in the job description. Likewise, the person who is not a publica servant but is the addressee of the job promises to afford or afford advantages fort he fulfillment or non-fullfillment of the duty. It is a spesific type of crime that is based on mutual and positive consents. Espacially in recent years, the increasing demand for plastic treatmants and the additional fees that doctors demand for surgery that have existed for many years have been evaluated in terms of the crime of bribery. The right to life is considered the most natural human right in the Constitution of Turkiye and international conventions. Reasonable Access to healtcare services, direvtly associated with the right to life, becomes challenging or even improbable due to bribery. Along with all these reasons, bribery crime has been investigated based on criminal liability of the healtcare providers.
