In this study trade unions are to be examined within the framework of the Turkish Constitution and the Law on Unions No 2821. Unions can take action both in labour-related matters and social activities. Activities related to judiciary suits are regulated in Law on Unions, Article 32 titled ?Activities Related to Labour?. Unions have the authority to sue a case and be engaged in a lawsuit, representing their members and their inheritors on the subjects to which the legislation relates to.In our study, judicial activities of unions are divided into chapters and have been examined. In the first chapter, the concept of union, the elements of unions and their functions as well as their capacity to sue and be party and later, unions? right of litigation on behalf of collective and individual entities are scrutinized in detail. Judicial activities and their relations are examined as well as union?s activities in other areas. Lastly, it is aimed to explain union?s judicial activities in international law, referring to international documents.While covering our study, sources based primarly on legislation, and then teachings of Turkish Labour Law and courts decisions related to unions have been discussed in the framework of collective labor law, procedural law, human rights law, European Union law.The aim of this study is to help to develop the study both collective labour relations of union?s and especially union member?s rights and freedoms.Key Words: Trade union, judiciary activities, union members and their inheritors, case.
