Abstract (EN)

In order to prevent the increasing workload in the justice system and the related violations of rights, some alternative solutions have been attempted to integrate them into the criminal justice system. Thus, in terms of some offences, it has been aimed to restore the public order that has been disrupted in a fast and effective manner. One of these alternative remedies is the speedy trial procedure. This institution, which belongs to the investigation phase, refers to a process that proceeds as the public prosecutor's offer to the suspect, the suspect's acceptance of the offer in the presence of his/her defence counsel, and the judgement of the competent court in accordance with the request prepared by the public prosecutor in terms of a limited number of crime types in the law. In our study, the position of the expedited procedure, which is relatively new to our criminal law, within the understanding of restorative justice, the benefits expected from this procedure and the conditions for the implementation of the procedure are analysed. In addition, a comparison with similar procedures has been made. In addition, the implementation of the summary procedure and the problems that may arise due to the implementation are discussed.
