Şeyhü’l-İslam Minkari-zade Yahya Efendi’s fatwas that concerned with marriage agreemant

Minkarû-zâde Yahya Efendi is a seyhulislam of Ottoman in 17 th century.This thesis aims to translate the fatwas to Turkish which are related to marriageagreement and constituted some parts of Minkarû-zâde Yahya Efendi?s fatwas that are relatedto family laws. Furthermore, the method, that he follows when he gives fatwa, aimsexplanation the sources which he uses mostly and the problems that were encountered inthisperiod of time.The research consist of one introduction and two parts. Introduction part aims thesubject of this research, the purpose and expression of the method. The first section aimsMinkarizade Yahya?s life and presentation of his works briefly. Besides it aims to makeanalysis of the fatwas which is related to marriage agreement.In the second part, the parts of Minkarû-zâde Yahya?s fatwas written in OttomanTurkish that are related to marriage agreement were translated to Turkish. Furthermore, theparts included with explanations of fatwas that are written in Arabic were translated toTurkish. This part consists of Kitâbu?n-Nikâh, Kitâbu?r-Rızâ fi?l-Muharemât, Bâbu?l-Mehr,Mâ-li?z-Zevc ve?z-Zevce en Yef`alâ, Fi?l-Cehâz ve Mesâilu?n-Neseb fi?l-Istûlâd.In conclusion part of the research, The method, that Mimkarû-zade Yahya followswhen he gives fatwa, aims to put forward the sources which he uses mostly and the problemsthat were encountered in this period of time.Key words: Minkarû-zade Yahya Efendi, marriage, radâ`, Mehr, Neseb, Cehâz.
