Processing of personal data at borders in the context of the right to asylum

The fact that states digitize border security and allow border crossings following the evaluation of the personal data that they collect reveals that borders are selectively permeable. This positions the state that wants to eliminate the potential threat, against the individual who faces a real danger in need of international protection. Although it is stated in legal regulations that the processing of personal data within the scope of border management is for national and international security and that the right to asylum will be respected in this process, it is seen that practices to prevent the right to asylum are not rare. However, the right to asylum should be an exception to the discretionary power of states on who they allow to cross their borders. The right to asylum, which is directly related to the security of the individual in order to exercise many fundamental rights, including the right to life and the prohibition of torture and ill-treatment, should not be confined to the security discourse of states.
