Insurance agent

General meaning of insurance agents is an independence merchandiser conducive, brokering underwritten or acting as a contracting body in behalf and account of insurance companies permanently in a certain area and/or region.Insurance agency contract is a judicial contract about bilateral rights and responsibilities between insurance companies and insurance agents. The required conditions of natural and legal entity involving in this business are prepared in Insurance Agency Regulation. The insurance agents, that met the required conditions in the regulation, are received the conformity certificate and declared to the Union of Chambers and Commodity Exchanges of Turkey to be registered into Signboard which includes the accepted agents after the evaluation by Undersecretary. In this manner, those entities could act as an insurance agent.The insurance agency contract, due to its nature, is a unique (sui generis) permanent functional contract that imposes debt to both absent sides. The significant portion of the representation power for insurance company, rights and liabilities of insurance agent and the termination of insurance agency have not been regulated through the insurance law and the regulation of insurance agency. Therefore, the relevant provisions of the trade law are going to be applied as long as it is appropriate to the structure of insurance agents.This study is constructed as three parts excluding ?Introduction? and ?Conclusion?. It is organized as ?The General Properties of Insurance Agents?, ?The Responsibilities and Authorities of Insurance Agents? and ?The Termination of Insurance Agency? at these three parts, respectively.The New Trade Law numbered 6102 and its comparison with Old Trade Law numbered 6762 are especially covered at the second part of this study.
