Perspectives on proposal practices of individuals who have insurance

Abstract (EN)

The conventional insurance system has started to be applied in Europe, especially with the development of the Mediterranean-based trade and it has become a systematic practice during the Industrial Revolution in England. However, institutions such as zakat, foundations (Wakf), beytü'l-mal (Treasury of İslamic State), craft guild (Trade Association) were seen as an alternative to the insurance system in Islamic countries until the 19th century. However, with the change in social life and economic conditions in the 20th century, almost all of these institutions lost their functions. With the loss of their functions, these institutions brought fiqh (İslamic Law) discussions with them. The decrease in the effects of the institutions that are alternative to the insurance system has pushed individuals to seek a suitable way out. As a result of these -attempts, the concept of "Tekâfül Insurance" has emerged. Takâfül insurance is a model based on mutual guarantee. This model is presented as a suitable model for Islamic law. Takâfül insurance is a model developed under the leadership of countries such as Sudan and Malaysia, today, it has become an alternative insurance model applied in European countries as well as in Islamic countries. The first model to be introduced in Turkey in 2010 began with Neova Insurance companies and this process has developed and grown with serious acceleration. With this development and growth, takâfül insurance, which supports itself and the participation in the structure of the international financial system has greatly influenced its inclusion in the financial system. With this effect, takâfül has assumed the supporting role of the insurance system in the financial context. The claim put forward in this study is to reveal the ownership principles of Islam regarding the insurance system - and to prove that insurance system offered by Islam, is more able to provide people with an atmosphere of peace and easier life compared to capitalist practices. A questionnaire method was used to collect data in the research. According to the result obtained with the applied survey method; in the temporary world life, the understanding of securing properties by providing all conditions with a model in accordance with Islamic law has been put forward. With the perception of a trustee in order to earn the eternal life of the hereafter, it was concluded that - an appropriate insurance system in the light of Islamic law, which respects property law, should exist.
