Abstract (EN)

In the first part of my dissertation, the conceptual framework of competition and insurance contract are introduced and the reasons of the competition and the relevance between the insurance sector and competition are examined. In this part, occurrence of competition infringements as a result of the concerted actions, agreements and decisions by the enterprise unions, and misuse of the dominant position are emphasized. Besides, necessary terms are mentioned for the compliance of these competition infringements with the law, through the ?exemption system?.In the second part of the dissertation, legal status in Turkey is analysed regarding the conditions of competition in insurance transactions and insurance transactions of the banks. Furthermore, within the framework of the views of State Council and Competition Authority, whether it is a competition infringement for banks to issue a life insurance to their clients from the companies that the banks determine, is analysed.In the third part, block exemption in insurance sector is examined, by means of comparing the European Union law regulations and Turkish law regulations.
