Abstract (EN)

The scope of the occupational accident in the Social Security Law is discussed in a much wider manner compared to other branches of law. Accidents which are not considered as occupational accidents in terms of Labor Law or circumstances which are not considered as accidents in terms of Law of Obligations are considered, in the presence of the necessary conditions, as occupational accidents in the terms of Social Security Law. Circumstances, considered as occupational accidents in the terms of Social Security Law, stated in Social Insurance and General Health Insurance Law. In this respect, in order for a circumstance to be considered as an occupational accident, this circumstance must be one of the circumstances stated in the Social Insurance and General Health Insurance Law. Whether the accident is accepted as occupational accident in the terms of Social Security Law, plays an important role in regulating the relationship between Social Security Institution and the insured party. Providing that an accident is considered as an occupational accident, the Institution shall provide various benefits to the insured party. In this respect, it is crucially important for both the insured party and the Institution to determine whether occurrence of a circumstance is an occupational accident or not. Consequently; in this study, the elements of the occupational accident in the terms of the Social Security Law, circumstances are considered as occupational accident, financial assistance to the insured party who have been damaged after the occupational accident or to the right holders in case of death of the insured party are examined in detail.
