Moral compensation claims arising from the infringement of personal rights through social media

The acceleration of digitalization and the widespread use of social media have created a new communication environment where individuals can freely express their thoughts and expressions. However, this environment has also brought with it the risk of violating individuals' personal rights. Sharing on social media platforms can sometimes harm individuals' private lives, honor and dignity, professional reputation or personal values such as name and surname. Such actions come to the agenda of judicial authorities in the field of private law, especially through claims for moral compensation. In this thesis, the legal dimensions of attacks on personal rights through social media and the moral compensation cases filed as a result of these violations have been examined. First, the conceptual foundations and historical development of social media have been addressed in the study, and then the place of personal rights and moral compensation in our legal system has been evaluated. In the second section, the legal consequences regarding violations of personal rights have been examined through the situations reflected in handcuffing agreements and divorce cases. In the third section, the balance between freedom of expression and personal rights in the social media environment has been examined in the light of court decisions. In this context, it has been concluded that a balance must be established between freedom of expression and personal rights, and that moral compensation can be an effective means of protection in cases where social media posts violate the rights of individuals. The study provides a comprehensive assessment for both academic and practitioner circles and draws attention to the new generation of legal problems caused by social media in particular.
