Abstract (EN)

During the recent years, Internet technologies have developed rapidly. The developments in internet technologies and the services offered by internet technologies have revealed the concept of "social media", which is a new concept. The rapidly developing and changing social media has created the newest and most effective use of freedom of expression. Social media, which is in every area of life, has become a new environment where crimes in the context of freedom of expression can be committed, in addition to the its benefits it provides in terms of freedom of expression. There is a close relationship between social media, which changes the way crimes occur, and crimes that can be committed in the context of freedom of expression. However, it has been realised that previous studies on this subject have only been dealt with in the context of social media and freedom of expression. For this reason, crimes that can be committed in the context of freedom of expression through social media are examined in this study. The infrastructure of the study consists of internet technology, development of social media environments, freedom of expression, detection and evaluation of crimes related to freedom of expression, differences between social media and traditional media, national and international conventions and judicial decisions. In the last part, with the structured interview technique, which is a qualitative research method, various questions were asked to the participants consisting of eight experts in the field and the subject of "crimes that can be committed in the context of freedom of expression in social media" was discussed. It has been tried to determine the effect of social media on crimes committed in the context of freedom of expression, whether it increases crimes or not, and the role of social media and social media providers in preventing crimes from being committed.
