Abstract (EN)
In the Article 5 of the Turkish Criminal Code, it had been stipulated that general provisions of this Law shall also be applied to special criminal codes and the crimes stipulated in the laws including penalties. Additionally, in the Article 3 of the Misdemeanor Law, Law Number: 5326, it had been stipulated that general provisions in this Law shall also be applied to misdemeanors stipulated in other Laws. In parallel to these stipulations, amendments in the Law regarding Fighting against Smuggling, Law Number: 4926 (which is deemed as a special code) and its adaptation in accordance with our new Criminal Code System had become obligatory. As this adaptation will require structural and detailed amendments, the Law Number: 4926 had been entirely abrogated and the new Law regarding Fighting against Smuggling, Law Number: 5607 had been put into force on March 31st 2007.
