Formation of legal framework for trademark registration in Turkey in the historical development process

Abstract (EN)

The Industrial Revolution, which starting in England, caused differentiation in production concept with the rapid development of technology. As a result, when product protections were insufficient, states enacted trademark and patent laws. In 1871, the first trademark law called "Fabrika Ma'mulatıyla Eşya-yı Ticariyeye Mahsus Alamet-i Farikalara Dair Nizamname" entered into force in the Ottoman Empire. In 1888, this was replaced by "Fabrikalar Ma'mulâtıyla Eşya-yı Ticariyeye Mahsus Alamet-i Farikalara Dair Nizamname". The "Fabrikalar Ma'mulâtıyla Eşya-yı Ticariyeye Mahsus Alamet-i Farikalara Dair Nizamname" was also applied in Republic of Turkey. After the Lausanne Peace Treaty, in 1930, Turkey joined the international industrial conventions. After this date, Turkey took its place in the international registration system and participated in conferences. Over the years, laws, decrees and regulations were put into force about trademark registration for adoption of the conditions. In 1965, with the enactment of the 551 numbered trademark law caused, "Fabrikalar Ma'mulâtıyla Eşya-yı Ticariyeye Mahsus Alamet-i Farikalara Dair Nizamname" abolished. In the study of thesis named "Formation of Legal Framework for Trademark Registration in Turkey in the Historical Development Process" the issues of how trademark registration took place within the framework of the regulatio applied since the Ottoman state, what kind of changes were made in the trademark registration for the need of time, what kind of attitude Turkey followed in conferences which took place to develop industrial property at the international level, the measures taken about the industrial property rights which had been badly affected in the world wars and the implementation and qualification of the contracts we joined were evaluated in detail.
