Investigation of the judicial decisions and the compliance with the legislation in the implementation of the imports in agriculture

In our country, projects are produced for the prevention of migration from rural areas to cities and revitalization of agriculture based economy. Studies on rural areas lead to changes in the rights of agricultural land. It is important to determine the values of agricultural land in the implementation works such as sale transactions of land owners, expropriation,confiscating without expropriating and lending in banking. In our country, there is no common legislation for land appraisal practices and the problems related to the regulation on need in different legislations are searched for in this study.In order to bring valuation studies to the courts and to provide long-lasting problems in our country, it is aimed to be objectively subject to subjective studies.Lens Value Increase application approach is designed for the application of appreciation of the authorities and experts involved in the implementation work. It has been calculated based on the land values of the appraisal applications accepted in our country. First of all, land and land concepts need to be distinguished in real estate appraisal applications. The application approaches for agricultural lands and land are differentiated in terms of valuation methods and differentiated according to the request of legislation. It has been determined that land valuation practices are subject to appraisal in terms of the content of the legislation and the application studies in the form of land plots, dry farmland and orchards.Application studies for agricultural lands which have a significant share in our country's economy were examined and evaluated with statistical analysis. Based on the results of the statistical analyzes, the accepted land evaluation documents obtained from the practices of our country were compared in terms of legislation and judicial decisions. In addition, the immovable values of the expropriation practices were compared with respect to land types and the irrigated farmland. It is observed that there is no common order in our country on the valuation of agricultural lands and it has been understood that the analysis of the factors affecting the value cannot be performed in the valuation practices of agricultural lands. Appraisal practices of agricultural lands have been examined in terms of judicial decisions and legislation and it has been determined that incompatible results have emerged on the immovable values through application examples.
