Abstract (EN)
Compatibility of the will and its explanation, one of the most important components of the legal processes and transactions, directly affect the validity of the transaction. In this context, compatibility of the will and its explanation is a condition which is compulsory on establishing the transaction in a valid way. There is an incompatibility created deliberately by the owner of the will and the opposing party between the will and its explanation in collusion. The legal transaction constituting the subject matter of the collusion does not result in the judgment and conclusions. This situation is seen especially in the transactions which are aimed at transferring an immovable property and assets. That the transaction aimed at transferring an immovable property does not comply with the actual will of the parties is invalid due to the fact that the secret transaction is against the formal procedure.
