Abstract (EN)

Medical malpractice is one of the most discussed multidisciplinary issues of medical law. Although draft laws on the physician's liability arising from medical malpractice have been brought to the agenda since 2002, they have not yet been enacted. It is very important to draw the concept of complication and the boundaries between these two concepts, which differ greatly from medical malpractice in terms of the existence of responsibility. In our study, the concept of medical intervention and the conditions of a legal medical intervention are included. Subsequently, the elements of medical malpractice, types of medical malpractice, and dogmatic foundations of medical malpractice are discussed. In addition, physicians 'compensation liability and physicians' compulsory liability insurance are also among the issues examined in our study.
