Abstract (EN)

Medical intervention is a practice that is carried out for the bodily integrity of patients. In this respect, it is the most natural right of patients to request information about medical interventions at every stage. Therefore, enlightenment of patients should be provided by physicians. Afterwards, the patient can give consent to the medical intervention procedures to be performed depending on the clarifications made. Patients cannot be expected to give consent to medical intervention procedures that they are not informed about. In this respect, before the medical intervention procedures to be performed, the patient must be informed and the consequences of this intervention must be mentioned. Therefore, physicians are obliged to enlighten. If informed consent is not obtained, the medical intervention procedure will be considered unlawful as a rule. Informed consent is included in many national and international regulations. As it is understood from here, enlightening patients is their legal right. It is important when and by whom the patient's consent will be given, and by whom, when and in which way the enlightenment will be made. The aim of the research is to determine the legal framework of informed consent in medical intervention procedures.
