Abstract (EN)
The crime of threat is regulated in the chapter crimes against liberty in Turkish Penal Code (TCK) No 5237 in order to protect the legal sense of safety and the freedom of estabilising a person?s will freely and acting volitionally.Subject of the thesis is the crime of threat. The study is composed of two parts. In the first part, the consept of freedom, the protection of liberty in constitution and penal codes, the definition of threat, differences of crime of threat between new penal code and TCK No 765, the regulations in comparative law, the differences among crime of threat and similiar ones, the legal benefit of crime, the components of crime and reasons effecting wantonness are explained. In the second part, the qualfied situations of crime, the special appearences of crime, the prosecution procedures and sanction of crime are studied.
