Legal right of mortgage of the shipyard owner

In this study, the right of mortgage of the shipyard owner is examined within the framework of Turkish Commercial Code (TCC) Art. 1013. In order to protect the rights of the owner of the shipyard related to the claims for construction and repair the Turkish legislator granted the right to request the registration of the mortgage on the ship constructed or repaired, under TCC Art.1013. The subject is examined within the framework of provisions in relation to the establishment of the subject mortgage of the Turkish Civil Code, provisions for mortgage of ships under construction and ship mortgage provisions in the Turkish Commercial Code by making explanations and comparisons with the construction mortgage institution arranged in Turkish Civil Code in some places where it is deemed necessary.
