The registration and announcement of trade register effect on the third persons

In our this study as a basis was taken the legal effects in terms of third parties of registration and publication in the commercial registry which regulated in Article 36 of the Turkish Commercial Code No: 6102. In this context the meaning, content and characteristics as well as the theoretical foundations were explained and also the interpretation and implementation, in the judicial case law, of the registration and publication in the commercial registry with regards to third parties were examined in detail. The different appearance, in the doctrine and judicial case law, of the effect on third parties of registration and publication in the commercial registry was clarified. While all of these was done, the subject was examined by including the different views in the doctrine and, as far as possible, the judgments.
