Analysis of movable pledge in commercial transactions law (In terms of Commercial and Property Law)

It is clear that small and medium-sized enterprises (SMEs), one of the building blocks of economic life, should be supported to make more contribution to economy and to boost economic life. Law on Pledges over Movable Property in Commercial Transactions aims to achieve this aim by making access to finance easier for SMEs. Easy access to finance means economic recovery, trade volume growth, and increase in competitive power. In order to realize this aim, the provisions included in the law issued must be of a quality that can really serve that purpose. In the present study, a general examination of the Law on Pledges over Movable Property in Commercial Transactions was performed and solutions along with possible problems that can be faced during the process of realizing the aforementioned aim were addressed. The study mainly emphasizes on property being the subject of a pledge and methods of putting a lien on property. It is unquestionably necessary to carry out scientific studies in order to better understand and implement the Law. Comparisons were made between the current Commercial Enterprise Pledge Code and the abolished one while the Law was being examined. Our work has been prepared with the amendments made in the Law No. 7099 and the Regulations published in the Official Newspaper dated 22 May 2018.
