The dimensions of the Law of Assembly and Demonstrations, the police interference responsibility and boundries

Fundamental liberties safeguard, the liberties and possessions of individuals against attacks. One of these fundamental rights, right to assemble and demonstrate, helps the individual express himself freely and shift his thoughts from a constricted field to a broader arena. It is protected by international agreements, and refers to the individual's right to express himself freely with people sharing the same views. In the exercise of this important right by people, the police should act in accordance with the principles stated in the Constitution keeping in mind the human rights at all times. Otherwise, violations on the part of the police may be encountered during the use of this right. Social events need to be considered in a versatile manner. Hence, the Law No. 2911 pertaining to assemblies and demonstrations and the regulations governing its application should be approached from a broad perspective. Especially the national legislations should be modified so as to match international legal norms. The Administration, which is expected to comply with legal norms as far as the freedom of assembly and demonstrations is concerned, is supposed to be well-equipped and fair towards the society, through the police force. Incorrect use of power on the part of the police may lead to violations of this law. This study deals with activities carried out by people to promote a certain issue by trying to form a public opinion, and police interference and enforcement they may encounter during the execution of such activities. The main objective of the study is to evaluate related national and international regulations and police applications by determining the dimensions of the freedom of assembly and demonstrations, and to conduct a feasible analysis in order to cast light on the police applications in our country. While carrying out this investigation, the Law No. 2911 and the regulations governing its application were approached from the viewpoint of Mobile Police Force regulations, and the interpretations of the Supreme Court were made use of in particular.
