Authority condations and defination of authority of labour unions on collective labour agreement

Trade Union is an organization formed by workers in order to protect and promote its members economic and social rights and interests in labour relations. Main tool unions use to realize their aim is the collective labour agreement. As a result, collective labour agreement has great importance on worklife.Because of the importance of the collective labour agreement on worklife, detailed amendments have been made by law maker for unions to make collective labour agreement with Collective Labour Agreement, Strike and Lockout Law numbered 2822. In the same way, some important amendments related to this subject existed in Trade Union Law numbered 2821. Than to developing and changing worklife condations, law maker considered that new arrangements must be made on this subjects and at the moment a law draft anticipating changing on both acts is on the agenda.Condations brought with the act of collective labour agreement that can be made combines under the authority of collective labour agreement. First, collective labour agreement side that is supposed to posses the efficiency according to the law has to posses the authority condations after providing this condations. But authority condations have been given to emloyees side. For employers side, having efficiency is sufficient.Our study consists of five main sections. First, for the well-understanding of the subject, basic concepts related to collective labour agreement considered and later that, for the authority of the collective labour agreement, prerequisites for the efficiency considered and compared with the authority. In other parts, authority condations, definition of authority, objection on definition of authority and consummation of authority studied.The aim of our research is to examine the properties, development and importance of making collective labour agreement using the law, act, law draft and the previous studies on this subject.KEY WORDS: Collective Labour Agreement, Labour Unions, Efficiency, Authority.
