An analysis of divorce with its social, cultural and communicative aspects

This study comprises the interpretation of marriage and family relations as they are declared in the form of grounds for divorce in the family court, as well as the examination of family courts in terms of their physical properties.Having analyzed the data, obtained before, during and after the cases of divorce, through participated observation and detailed interviews, we tried to devise a map of experience of divorce and find the linguistics equivalents of grounds of divorce, which are stated in a highly specific legal language as they are used in daily language. In virtue of these daily equivalent terms, the meanings attached to the notion of marriage and family life are sought through the analysis of the social, cultural, and communicative grounds of divorce, as well as the signifiers of divorce.Family court is a place of seeking rights, punishing, staging of performances and an arena of struggle. Discourses of divorce signify the acts, which damage the emotional contract between the spouses and are reinforced through repetition. These acts are the consequences of mental worlds, economy, the dialectic of freedom-loyalty-merit, accelerators such as authority under the guise of respect, and unforeseeable qualities that come about as a result of the nature of marriage. It was observed that the discourse of women is becoming to be more prominent vis-à-vis the discourse of family as well as the fact that grounds of divorce do not refer to class differences.The role of the family should be considered in individual cooperation as much as it is considered in the social cooperation. The decision to get married should be the result of an ontological wisdom and depth at the individual level. Reminding ourselves of the fact that family court is the place of separating spouses with problems, there is a need for institutions that will help these spouses to reconcile through helping them solve their problems and save the marriage thus reducing the work load of the court and enhancing the quality of the judicial process.A legal structure might be prepared to allow the volunteers work in family courts. There should be cadres in family courts allotted for sociologists. Original studies carried out in family courts will provide us with clues through which a model of family in harmony with the necessities of a society in transformation and which provide us with the facts about the requirements of establishing and sustaining happy marital unions.
