Özet (EN)

The importance of any kind of knowledge is increasing under the influence of advancing technology in today's world day by day. The period's that we experience being called as "information age" or "data age" is the clearest indication of this situation. For this reason, it is inevitable that individuals and institutions enter into the race of having information of other people. Article 135 and following articles of the Law No. 5237 of Turkish Criminal Code aim to protect individual's private life and privacy from the potential negative effects of that situation. In this thesis, violation of "Unlawful Delivery or Acquisition of Personal Data" as set out in Article 136 of Law No. 5237 of Turkish Criminal Code will be studied. When the examination of this crime is being carried out, regulations will be compared between the data which should be protected under the Law No. 6698 of Protection of Personal Data Law, legal regulations in the field of medical and a perspective will be represented in order to detect and eradicate the points which might cause contradiction. In this context, the main purpose of this study is to examine the elements of the crime of "Unlawful Delivery or Acquisition of Personal Data", as well as to reveal its relationship with other legal regulations related to the subject of the crime and to clarify the position of the crime in the legal system by drawing the limits of these relations.
