Abstract (EN)

The cause of existence is human and life medicine; ıt is closely related to the philosophy that aims to find out the truth by examining consepts such as law, values, homework and benefit, wich are based on the understanding of weak protection against the strong. Ethical evaluation of practical and sc ientific studies in the field of health and medical ethics that enoble the resolution of ethical dilemmas; Kant's duty, Mill's pracmatic approach constituted the building blocks of these basic principles, along with the basic medical principles of harmlessness, utility, justice and autonomy. Because the right to health is linked to the right to life, we tried to provide constitutional guarantee on the basis of universal legal legislation and legal arrangements were made in this law. Physicians face legal sanctionsifthey do not fullfill their obligations. When appyling these legal sanctions , the case of malpractice complication discrimination of the plaintiff is changing the result of the case . Especially in 2005 the aggravation of Turkish Criminal Law put pressure on physicians. The defensive medical behavior, wich means deviation from ideal medicine, is caused by factorssuch as the privatization of health, the Full Day Law and Performance Based Supplemental Payment System, the Occupational Liability Insurance, the inadequacy of education given in medical faculties, and the change of understanding of medicine.
