Abstract (EN)

Warranty liability and after-sales services are a strict liability stipulated by law, taking into account the problems that the consumer will experience in the demand for the removal of malfunctions that may occured during the use of the product subject to consumer transaction. However, in practice, the fact that consumers are unaware of their rights they have within the scope of this responsibility and the effort to avoid fulfillment of the obligations stipulated in the Law by the people who are the counterparty of the consumer transaction, the discussions on different aspects of the subject in the doctrine bring many problems. The solution of the specified problems requires another examination on them and, in doing so, the provisions of the Law, preamble of the Law and the Regulations for the implementation of the Law and the Supreme Court desicions related with the implementation of Law. In this context, as a liability arising from the warranty certificate and after-sales services law, it brings additional rights and protections to the rights of the consumer in accordance with the general provisions and liability for defects, while improving the powerless position of the consumer as a result of the adoption of the principle of joint liability.
