Abstract (EN)

The subject of our work is the protection of personal data in consumer contracts. Within the scope of our subject, at first, the concept of personal data was addressed in general terms. In this analysis, general information about the definition, factors, types and legal nature of personal data was given. Then, the status of the personal data of consumers, which constitutes the main subject of our study, was discussed. In this context, the processing of consumer data based on explicit consent and without consent, consumer contracts in which sensitive data is recorded, and the conditions required for the processing of sensitive data were examined. Within the scope of our review, the opinions in the doctrine and the Supreme Court's application regarding the problems consumers encounter during the personal data processing activity were discussed. In the last part of our study, criticism and suggestions were made by drawing attention to the means that the consumer can apply in case of violation of personal data and the lack of legal regulation in our legislation in terms of consumer protection.
