Abstract (EN)
Upon the conditions of public interest, government can limit the right of private property through certain measures. The most widely implemented of these measures is expropriation. Expropriation is acquisition of private property via force majeure for public use under the right of eminent domain. The fundamental condition of this procedur both in Turkish and German law is public interest. In this study, there two legal systems were investigated, the common and differing issues were searched, and findings were presented in "Results and Suggestions" section.
