Abstract (EN)
Judging of the senior officials of a state for the crimes related to their duties is a special case due to the nature of the work. Therefore, the authority of judging these people for their crimes related to their duties have been given to Supreme Court. Even if there are different applications, Supreme Court is an institution that exist in all countries in general. Each country has given place to this institution in their law systems in a way. In our country, Constitutional Court carries out the task of Supreme Court since 1961.In fact, Constitutional Court is not an institution that many referred as Supreme Court. Making criminal proceedings is an exception for Supreme Court which has the main task of checking the constitutionality of the norms. Constitutional Court is not institutionalized as a criminal court. For that reason it has taken many criticism about Supreme Court authority and adjective. These criticisms generally have been about the institutional structure of the court and the election and the composition of the members.The aim of our study is; finding answers to the criticisms about our Supreme Court System by examining the concept, the structure and the systems and the historical development of Supreme Court with the examples of comparative law.
