Abstract (EN)

The crime of plunder which is defined as obliging someone not to resist to delivering the possession of movable property or another person at the crime scene either by threat or use of force is regulated between the 148th and 150th articles of 5237 numbered Turkish Criminal Law. The classic plunder crime which is the under the 148th article?s 1st subsection of the Turkish Criminal Law and the plunder of receipt has been imposed sanction under the 2nd subsection of 148th article in Turkish Criminal Law.The personal freedom and physical integrity have been preserved as well as the protection of property official value with the help of the crime of plunder. Thus, the crime of plunder has been imposed sanction by different communities until today.The act of taking a movable property of someone or receipt either by force or threat has been punished. For this reason, immovable properties can?t be part of the crime of plunder. Everybody might be offender of the crime of plunder. However, the victim of this crime is the owner of the property or movable being imposed to injustice. The crime of plunder is a typical example of compound crime. For this reason, the offender isn?t punished additionally for force, threat or thefts which compose the crime of plunder; he or she is only punished for the crime of plunder. The crimes of plunder are among the crimes which might be committed on purpose. The investigation of the crimes of plunder is done by the Public Prosecutors personally.
