In this study, the issue of fulfilling legal provision as the reason for legal compliance in Turkish Criminal Law has been examined in terms of conceptual framework, historical development, the situation in comparative law and the conditions of fulfilling the legal provision, some special legal regulations and their results. The reason of legal compliance in the form of fulfilling legal provision causes the action's being lawful from the beginning by eliminating crime's elements that are contradicting to law. Thus, no responsibility can be assigned to perpetrator of the crime. The reason of this is putting the social interests before the private interests that are damaged as a consequence of fulfilling the legal provision. In this context, a balance between authority and freedom should be struck and appropriate legal framework that enables the ones, bringing the laws into action, to act within the scope of rules and legislation should be generated.
