Abstract (EN)

The narcotic and stimulant substance, which has been found to be used from the history of humanity to the present, was first used with its anti-disease and pain reliever functions. However, this usage has deviated from its purpose day by day. This situation required intervention against drugs and stimulants. Globally, countries have carried out activities to combat drugs or stimulants. As in the whole world, a struggle is being waged in Turkey as well. There are many legal and administrative regulations in Turkish domestic law in the struggle. One of these regulations is the "Manufacturing and Trafficking of Drugs or Stimulant Substances" in Article 188 of the Turkish Penal Code. Within the scope of the law, the production, import and export of drugs or stimulants in an unlicensed or illegal manner, as well as their sale, purchase, offering for sale, transport, storage, possession or giving to others are sanctioned. In addition, the manufacture and trade of raw materials that do not have a narcotic or stimulant effect but are used in the manufacture of narcotic and stimulant substances are also sanctioned in this regard. In this context, it is aimed to examine the regulations related to the crimes evaluated within the scope of the manufacture and trade of narcotic or stimulant substances in the Turkish Penal Code and to evaluate them with other national and international legislation.
