Abstract (EN)
Within the economical system ofWestern countries,first the autonomy of collective work agreement rised and,this is followed by legal evaluations and regulations.This development is reached without affect of government but due to the structure of liberal economical system by nature.lt is realized that autonomy of collective work agreement is accepted because of necessity,in spite of government and legal regulations. In western countries,social and economical life has been developed since industrial revalution in 18. Century.Turkish society has applied same economical system and accepted its results where there was not the same development of industry and economical power.As a result, without living this development period,Turkish society has accepted straightly the autonomy of collective work agreement too. The autonomy of collective work agreement can find an ideal base with the help of collective social rights which is made of collective work agreementrights and freedom,union rights and freedom and,strike rightsJn case of an absence of one of these collective rights,autonomy wiH'not exist.Freedom of unions is a base for collective work agreement and,strike rights are also a threaten in the same way.The aim of autonomy is to have an ideal form of collective work agreement. Autonomy of collective agreement shows the use of a power.This power is the responsibility of both sides which they cannot make rules for the third side also within their objective rules.Any arrengement to remove this responsibility will remove the autonomy also.The power of collective agreement will be a real power only if there is union rights and strike rights together.The power of autonomy could not be limited. The power autonomy and making rules are clear and definite with the Constitutional Law as of its aim subject.
