Abstract (EN)

Slavery has been practiced by almost all governments and seen in societies throughout most of human history. Traditional slavery refers to legal status by establishing property over another person. However, the world has changed a lot in the period from the abolition of slavery which has existed throughout history to the 21st century. Modern slavery which includes violations of human rights such as human trafficking, debt bondage, domestic slavery, forced labour, sexual exploitation, child abuse, and organ trafficking accelerated with globalization. For this reason, it can be said that these applications are one of the biggest problems of today. The aim of this thesis is to examine the prohibition of slavery, servitude and forced labour within the framework of the views of thinkers and practices in the historical development process. The reflection of the prohibition of slavery, servitude and forced labour in Turkish law is discussed in the context of both the constitutional development process and practices. Likewise, this prohibition in Article 4 of the European Convention on Human Rights has been examined in the light of the decisions of the European Court of Human Rights. In this context the decisions of the Constitutional Court of Turkey were compared to decisions of the European Court of Human Rights. At the same time, the standards applied by these courts in terms of this prohibition were tried to be explained.
