Abstract (EN)
Pardoning power of has a very old history. When the right to punishment came into the hands of state power, the authority which had this right also has the power to forgive. Amnesty is defined legally as for giving offense and not punishing the perpetrator for the offense committed. As the head of state, the president has the authority to commute or remit the sentences imposed on person in cases of chronic illness, disability and old age as specified in the Constitution. Inourmasterthesis, we will explain in detail the President's authority to pardoning in Turkish Law. The aim of this master thesis is to determine the status of the pardoning power of the President in the historical process and to explain the scope and limits of this power. In this regard, in the first part, the position of the President in Turkey has been examined in terms of government systems, the concept of amnesty and its types are explained and their characteristics are stated. In the second section, the President's pardoning power is explained during the historical process. In the third section, the place of the President's pardoning power in our legal system has been tried to be explained in terms of the Constitution and Criminal Law.
