Abstract (EN)

The aim of this study is to examine the equalization claim right of the agency regulated in the Turkish Commercial Code No. 6102. The agency is regulated between articles 102-123 of the Turkish Commercial Code No. 6102. Since the agency undertakes the services of representing the client in a certain region, making a contract on behalf of the client, marketing the goods and services produced by the client and providing continuity, it creates a customer environment. Under these conditions, even in the event of the termination of the agency agreement, the right to claim compensation from the agency side arises because the client continues to benefit from the customer base gained through the agency. In other words, the client will continue to benefit unilaterally, while the agency will not benefit from the client environment it has created for the benefit of the client within the scope of the agency agreement. This situation forms the basis of the right to claim compensation compensation from the agency side. The main subject of our thesis is the legal nature and conditions of the agency's right to demand compensation compensation and the way it is calculated in a possible claim of the agency.
