Assurance account in Turkish law

The historical development of the Assurance Account in Turkish Law has been examined and the legislation has been discussed comparatively. Assurance Account institution is not included in the KTK numbered 6085. For the first time, the institution of the Guarantee Fund, which is directly related to the work, entered our legislation with the KTK No. 2918. Although the Guarantee Fund institution has been brought to a legal basis, it has been criticized that its scope is limited only to Compulsory Traffic Insurance. With the Insurance Law No. 5684, this deficiency was eliminated and the compulsory insurances listed in the relevant article were included in the Assurance Account. Although this regulation is in place, it is foreseen that its scope will be further expanded. The Assurance Account institution, which was adopted in order to fill the gaps in the compulsory insurances and not to leave the third parties harmed, and to protect the trust in the insurance, is an important development in this sense.
