Abstract (EN)
Countries take a variety of precautions in their domestic law in order to prevent illegal transplantations. While one reason on which these precautions are based on is to prevent violations of human rights caused by illegal organ transplantations, the other reason is to effectively struggle against organ shortage, a very important problem all over the world and organ trafficking caused by this shortage. For this reason, many countries consider organ and tissue provision which is illegal and is especially carried out for economic advantage of the donor as organ trafficking and they impose sanctions. One of these countries is Turkey, and Turkish Criminal Code stipulates that sanctions are imposed on organ and tissue provision from donors in exchange for economic as crime of organ trafficking. In this thesis study, reasons of organ trafficking and provisions of Turkish Criminal Code about organ trafficking will be elaborated in detail after when organ provision from alive people or dead people is legal is investigated. After organ trafficking which is called as provision of organs from living bodies in exchange for money and in an illegal way is discussed in terms of violations of human rights which may be caused by organ trafficking to the detriment of alive donors in discussion and result parts of the study, a variety of legal and social solutions will be presented so that they can be effective for struggle against this crime.
