Abstract (EN)
By nature, humans are compelled to live together in order to survive and meet their needs. As a result, since the dawn of humanity, people have continued their lives within societies. However, it is inevitable that conflicts will arise among individuals within any given community. In order to prevent such conflicts, legal rules have been established. These legal rules may sometimes be violated by individuals. When the rules within the field of criminal law are violated, and other necessary conditions are met, the legal institution referred to as a crime will arise. To maintain social order, many crimes have been established through criminal law, and these crimes are categorized into various groups based on the legal values they violate, such as crimes against sexual inviolability, crimes against life, and crimes against property. One of these groups consists of crimes against freedom. The subject of this study is the crime of stalking, which is outlined in the second book, second section, and seventh chapter of the Turkish Penal Code under the title "Crimes Against Freedom." The aim of this study is to reveal the historical development and general structure of the crime of stalking, examine in detail the provisions related to stalking in Turkish law, and offer solutions to potential problems that may arise in practice
