Abstract (EN)

In Turkish Criminal Law, different regulations have been introduced to protect children who have been involved in crimes from the damaging and negative effects of the trial stages compared to adults. The fundamental aim of the principle of the best interests of the child, which forms the basis of these special trial procedures, is to protect the child throughout the trial and to reintegrate them into society with protective and supportive measures until the end of the trial. Evaluations have been made regarding the periods before and after the age of 12, which is considered as the starting point of the child's culpability and blameworthy state. In the second part of our study, along with protective measures, special interrogation and questioning procedures during the investigation stages for children in the position of suspects, are discussed. Situations where the public prosecution is initiated or deferred after the conclusion of the investigation stage are also addressed. In the final section, special circumstances regarding the trial conducted in juvenile courts have been evaluated, focusing on the foundation of the prosecution phase. The outcomes of the prosecution phase, namely acquittal or conviction, have been assessed. Data on the reasons for choosing imprisonment or fines in the decisions concerning children found guilty and sentenced, as well as statistics on predominantly imposed penalties, have been examined to obtain information for the reintegration of children into society.
