Prosecution service within the context of fight against crime in Turkish law

It is an undeniable fact that crime rates among the society increases day after day. The aim of this study is to make contribution in the field of fight against crime which is the basic building block of social peace and public order. In this context role of public prosecutor comes into prominence within the scope of criminal justice system which is considered as a crime fighting mechanism. Within the study primarily crime and criminal sanction phenomenon are investigated in the view of basic theories. Then the historical development process, structure and functions of prosecution are examined. In the third part decisions of prosecutor which concludes the investigation, alternatives to prosecution in criminal procedure law and the role of prosecutor within the criminal justice policy are investigated. It is predicted that there is an uncertainty around the organization and positioning of public prosecutors in the Turkish criminal justice system. This matter negatively affects the fight against crime. The duties and authorities of prosecutors need to be determined in order to decrease the crime rates. In this respect public prosecutors must be positioned as the performers of criminal justice policies. For this purpose, they shall be strenghtened to ensure the coordination between the organisations fighting against crime.
