Abstract (EN)

In this PhD thesis, the subject of competence element of administrative act in Turkish administrative law is discussed in detail. The competence element of administrative act is a quite comprehensive and significant issue. For the reason that, it is important who will carry out the administrative act that creates a change in the legal field of the relevant parties and what the limits of this person will be. The competence element is directly related to constitutional law issues as well as administrative law issues. In Turkey, there is not any general administrative procedure code which regulates the rules of competence. Therefore, there are many problems related to the competence element in the doctrine and courts decisions. In this context, the aim of our study is to contribute to the solution of many problems related to the competence element that arise in doctrine and judicial decisions. In this regard, the concept of competence and its characteristics are examined in the first part of this doctoral thesis, which consists of four parts. In the second part, the competence element of the administrative act is analyzed in detail. In the third part, the exceptions to the use of competence; in the fourth part, the illegalities that occur in the element of competence and the sanctions of these illegalities are discussed.
