Özet (EN)

Human organ and tissue transplantation were made from ancient ages. Enacted in many laws worldwide including Turkish and Iraqi Laws. Organ and tissue transplantation can be done on live humans and cadavers. The rate of Organ and tissue transplantation from cadavers is high than live transplantations and transplantation from cadavers is more useful because you can transplant more than one organ and tissues at the same time. In the past when (Heart and Respiratory Systems) stopped accepted as classical death. But many critics this application, then brain death accepted as real death. Individual accepted as death only after all body's physiological functional stopped. There are laws organized for Organ and tissue transplantation. Many conditions have been set to organize Organ and tissue transplantation in Turkish and Iraqi Laws. Additionally, transplantation must be donated and consensual. The transplantation must be benefit of patient. The psychological, familial and social results of transplantation must be explained to donator. Organ and tissue transplantation trade forbidden in many World Laws including Turkish and Iraqi Laws and accepted as rape of Human Rights. Inflicted punishments like penalties and prison sentence. Those punishments were applied on perpetrator and associated persons. Laws adopted issues regarding Organ and tissue transplantation because it is related to lofty living creature which created by Allah.
