Abstract (EN)
Freedom of contract is basically regulated in the Law of Obligations but due to it is importance it can be applied in many areas of private law. According to the freedom of contract the parties can determine the content of a contract as they wish provided that is complies with the basic limits in the law. İn Labour Law, fundamental freedom of contract has been adopted. However this freedom has been subject to some limitations with social and economic thoughts. According to this in some cases contract are prohibited and in some cases the obligation to sign a contract is envisaged. İn order to understand the scope and limits of the freedom of contract in Labour Law, it is necessary to examine the concepts of contract and freedom in detail and then to examine the meaning of the concept of contract freedom especially in terms of Law of Obligations, Constitutional Law, Civil Law, Roman Law and International Conventions. For this purpose, the subject will be examined systematically and the result will be emphasized.
