Abstract (EN)

In this thesis entitled "Right to Work in Turkish Labor Law", firstly, the place of the right to work, which is a fundamental right in the Constitution, among human rights has been tried to be explained, and in this context, the classification of human rights and the nature of social rights that include the right to work are mentioned. Then, within the scope of our study, the horizontal effect of fundamental rights on the applicability of constitutional rights among individuals was examined. In the following, it has been tried to convey how the right to work is included in the international regulations and the decisions of the Constitutional Court in terms of the contribution of the international regulations on the right to work to our labor law. Finally, by examining various legislative regulations that are an extension of the right to work, how both the Constitutional regulation, and the international regulations regarding the right to work are reflected in our national legislation is given. While the subjects mentioned within the scope of our study are discussed, the controversial issues in the doctrine have been tried to be emphasized, and the practices of the higher judicial organs on the subject are given.
