Abstract (EN)
Right to prove provides both parties of a court case, right to access and use requisite documents to prove their claims. This may require the other party or a third person who is totally irrelevant with the court case to disclose such documents. Consequently, legislator made an exception to the rule of nemo tenetur edere contra se, a common rule compelling parties from mandatory production of evidence to be used against themselves, to clarify the proceedings and establish the rule, ?Compulsory Production of Documents (Turkish Code of Civil Procedure Art. 326-336)?. This dissertation purposes to determine the state of ?Compulsory Production of Documents? in Turkish civil procedure law as a common rule in modern legal systems with varying importance.
