Abstract (EN)

Humanity has tended to take precautions against the social risks it has faced in its life since ancient times. Death is a social risk that is not sure when it will occur, but it is not doubted that it will happen. In Turkish culture since ancient times, family members have been protected by various aids made by the state and society upon the death of the person responsible for supporting the family. Today, with the survivors insurance that comes into effect after the death of the insured, it is aimed to cover the income losses of the right holders of the deceased insured. The most important of the rights provided from the survivors insurance is the survivors pensions granted to the right holders in case certain conditions are met. However, the fact that the right holders are entitled to a pension does not mean that right holders will receive this pension continuously. If the conditions for joining the pension are eliminated, the pension of the right holder is cessated. In the first part of our master's thesis on the Cessation of Survivors' Pension in Turkish Social Security Law, the concept of social security and the risk of death were mentioned in general, and the emergence and historical development of survivors' insurance was emphasized; then, the conditions for benefiting from the death pension were discussed. In the second part, the regulations in the Social Insurance and General Health Insurance Law No: 5510 and the abrogated laws regarding the cessation and reconnection of the survivors' pensions of the right holders are evaluated together with the doctrine and the Supreme Court decisions. In the last part, the issue of the termination of the survivors' pension of the daughter or widow who is found to be living together with her divorced spouse.
