Abstract (EN)
The provisions on good faith as contained in Turkish Commercial Code have had their implications on the Code in different forms and by being rated among themselves. Moreover, in evaluating these provisions, not always the meaning in art. 3 of Turkish Civil Code comes into view, but showing different approaches is necessary. Departing from this requirement, in addressing the provisions of Turkish Commercial Code on good faith, we designate them as the Forms of Appearance of Good Faith in Turkish Commercial Code. In this sense, the respective provisions of the code have been examined upon being gathered in four groups. These are the provisions of Turkish Commercial Code on good faith within the meaning of art. 3/2 of Turkish Civil Code, the provisions of Turkish Commercial Code whereby art. 3/2 of Turkish Civil Code is indirectly pointed out, those provisions of Turkish Commercial Code inherently contradicting with art. 2 of Turkish Civil Code although it uses the term bad faith, and those provisions of Turkish Commercial Code where it seeks intention.The study in question aims to reveal the difference in terms of its structure and meaning.
